Terms of Service

Welcome to Fantasy Beef ("we," "us," "our"), operated by Fantasy Beef Inc., located in Calgary, Canada. By accessing or using our website at fantasybeef.com (the "Platform"), creating an account, participating in a draft, or purchasing any product or service through the Platform, you ("you," "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Overview of the Service

Fantasy Beef is a technology platform that facilitates the purchase and distribution of locally raised, whole-animal beef shares through a live, fantasy-sports-style draft format. We connect consumers ("Drafters") with independent ranchers and farms ("Ranch Partners") and coordinate butchering and fulfillment logistics. Fantasy Beef does not raise, slaughter, butcher, process, package, or transport any livestock or meat products.

2. Eligibility

You must be at least 18 years of age and a resident of Canada or the United States to use the Platform. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Account Registration

To participate in drafts, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@fantasybeef.com if you suspect unauthorized access.

4. Draft Participation and Payment

4.1 Commitment. When you claim a spot in a draft league, you are making a binding commitment to participate. Once all roster spots are filled, you will have 48 hours to submit payment. Failure to pay within this window will result in forfeiture of your spot.

4.2 Pricing. The price per share is displayed at the time you join a league. Prices are determined by the Ranch Partner, the size of the animal, and the share fraction selected (1/2, 1/4, or 1/8). All prices are in Canadian Dollars (CAD) unless otherwise stated.

4.3 Refunds. Due to the perishable nature of the product and the group-purchase model, all payments are final once the draft has been completed. Refund requests prior to the draft may be considered on a case-by-case basis at our sole discretion.

5. Product Disclaimer and Limitation of Liability

5.1 No Warranty on Meat Products. Fantasy Beef is a technology platform and marketplace facilitator only. WE DO NOT RAISE, PROCESS, BUTCHER, PACKAGE, INSPECT, OR HANDLE ANY MEAT OR LIVESTOCK. All beef products are sourced, processed, and fulfilled by independent Ranch Partners and their designated butchers/abattoirs.

5.2 Third-Party Responsibility. The quality, safety, handling, storage, transport, grading, labelling, and regulatory compliance of all meat products are the sole responsibility of the Ranch Partner and/or their designated butcher or abattoir. Each Ranch Partner is independently responsible for maintaining all required licenses, permits, inspections, and certifications mandated by federal, provincial, state, and municipal authorities, including but not limited to the Canadian Food Inspection Agency (CFIA), the United States Department of Agriculture (USDA), and any applicable provincial or state meat inspection programs.

5.3 Assumption of Risk. By purchasing a beef share through the Platform, you acknowledge and accept that:

  • Meat is a perishable product that carries inherent risks if improperly handled, stored, or prepared.
  • Variations in cut size, weight, marbling, and yield are natural and expected in whole-animal purchasing.
  • You are responsible for the safe handling, storage, and preparation of all meat products upon receipt.

5.4 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASY BEEF INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO: (A) THE QUALITY, SAFETY, OR CONDITION OF ANY MEAT PRODUCT; (B) ANY ILLNESS, INJURY, OR ALLERGIC REACTION RESULTING FROM THE CONSUMPTION OR HANDLING OF ANY PRODUCT; (C) ANY ACTS OR OMISSIONS OF RANCH PARTNERS, BUTCHERS, OR DELIVERY PROVIDERS; OR (D) ANY INTERRUPTION OR FAILURE OF THE PLATFORM. Our total aggregate liability shall not exceed the amount you paid for the specific share giving rise to the claim.

6. Ranch Partner Terms

Ranch Partners who list their operations on the Platform represent and warrant that they hold all necessary licenses, permits, and insurance (including liability insurance) required to raise and sell livestock in their jurisdiction. Ranch Partners are solely responsible for the accuracy of all information provided about their operations, including breed, feed program, and certifications. Fantasy Beef reserves the right to remove any Ranch Partner from the Platform at any time and for any reason.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of Fantasy Beef Inc. and is protected by Canadian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

8. User Conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) impersonate any person or entity; (c) interfere with or disrupt the Platform or its servers; (d) attempt to gain unauthorized access to any part of the Platform; (e) use automated tools to scrape or collect data from the Platform; or (f) post or transmit any harmful, threatening, abusive, or defamatory content through the message board or any other feature.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Personal Information Protection Act (PIPA), the Personal Information Protection and Electronic Documents Act (PIPEDA), and Canada's Anti-Spam Legislation (CASL).

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 5, 7, and 11 shall survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Canada and, where applicable, the laws of the United States of America. Any dispute arising from these Terms or your use of the Platform shall be resolved exclusively in the courts of Canada or the United States, as applicable to the User's jurisdiction. You irrevocably submit to the jurisdiction of such courts.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fantasy Beef Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform with a new effective date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
